A DUDLEY couple who caused misery to neighbours have been served an anti social behaviour injunction.

Shane and Jodie Whyte of Highgate Road, Dudley, will be evicted from their Dudley Council owned home if they do not leave - after a hearing at Walsall County Court.

Initially complaints were received about their children being abusive and threatening towards neighbours, but the inappropriate anti social behaviour escalated over the coming months to include racially aggravated assault and drunken and violent behaviour.

Their bad behaviour also included targeted abuse and threats, damage to council property and the use of cannabis.

An interim injunction was obtained by the council’s ASB team on November 5 2014 which placed an exclusion zone on the couple and ordered them not to use threatening or violence behaviour or do anything which could be construed as nuisance against individuals, witnesses or employees of the council.

Following continued aggravated behaviour the couple were brought to court on June 3, where the court granted a one-year extension to the ASB injunctions.

The Judge also added a power of arrest to Mr Whyte’s injunction after he was found guilty of a racially aggravated assault against a member of the public.

The council also obtained a possession order that will force the family to find alternative accommodation in the next couple of weeks or face eviction.

Dudley Councillor Gaye Partridge, cabinet member for housing, said: “Mr and Mrs Whyte are both banned from conducting anti social behaviour in the Woodside area, with the court injunction lasting until July 31 2016.

“This is an excellent result for everyone living in the area as it shows that we will not put up with anti social behaviour in our borough.

“I would like to say thank you to everyone who has made this injunction possible, in particular the residents living in the area. It is your courage which has made this possible.

“I hope this action serves as a warning to anyone else who feels that they can act in an inappropriate way – we will take action.

”Dudley is a community council and, as such, we believe in the importance of ensuring our borough is a good place to live, work and play. Anti social behaviour should not be tolerated.”
