A DUDLEY man who head butted his victim before punching him to the ground, where he was kicked and stamped on, has been jailed for six months.

Juswant Budhan was subjected to a considerable amount of racial abuse from the man in a Stourbridge town centre subway, said Samantha Powis defending.

She told Wolverhampton Crown Court how the 29-year-old accepted it was a "complete over reaction" but stressed, "this was certainly not wanton thuggery."

Miss Powis maintained Budhan would not have been appearing before the court but for the actions of the victim and his cronies.

Judge Sybil Thomas told Budhan she accepted there had been repeated racial abuse which was "something no-one should have to put up with."

But she said his behaviour was violent and persistent and, having walked away, he continually returned to lash out with more kicks and the stamping.

Budhan admitted assault causing actual bodily harm and the Judge told him it was fortunate the injuries he inflicted were not more serious.

She told Budhan:"The persistent nature of this attack means only an immediate sentence of custody is appropriate".

Timothy Sapwell prosecuting said it was accepted Budham has been racially abused in the High Street subway by a man who was clearly drunk after downing 10 pints of cider.

The victim of the attack, he went on, thought he knew Budhan and it was after an argument that he was butted in the face before being punched to the floor.

Budhan returned to him twice as he lay on the floor to kick him about the body before coming back a third time to stamp on his chest.
