DRUNKEN friends threatened a man in a Worcester street, one telling him he would 'knock' him out and the other that he would 'bottle' him.

Nathan Heenan and Peter Evans both admitted affray following the incident in Friar Street in Worcester.

Evans, aged 30, of HMP Featherstone was jailed at Worcester Crown Court and Heenan, aged 31, of All Saints Road, Worcester, received a community order the following day after the judge said he played a less significant role in the fight.

Richard Davenport, prosecuting, said the incident happened on April 2, 2016 at about 6pm and was reported to police by a concerned member of the public.

He said Evans had pushed his friend, Heenan, into another man and an argument took place with both defendants directing threats at the victim.

Mr Davenport said: "Mr Evans took off his jacket, saying 'I'm going to floor you, I'm going to knock you out. Give me your phone and headphones, give me everything you have'.

"This defendant (Heenan) said 'I'm going to bottle you!'

The victim could see the bottle in Heenan's hand.

Heenan accepted he had been involved in the disorder but denied any attempted robbery.

Heenan has 11 convictions for 17 offences, including dishonesty matters and an assault occasioning actual bodily harm from 2011 for which he received 16 months imprisonment. This was for an assault on a worker at St Paul's Hostel in Worcester where he was then living, the court was told.

Heenan was interviewed by a probation officer before he was sentenced, telling him he had been diagnosed with ADHD at the age of eight and used to drink cider every day but had stopped doing so because of his children.

The defendant, a father-of-four, had performed various jobs including warehouse work and had also been employed at McDonald's.

He told the officer he had been 'messing about' and that he had apologised to the victim at the time but his co-defendant began throwing punches at him.

Heenan said he had not seen his co-defendant since the incident.

Belinda Ariss, defending, said the incident took place over two years ago. "Both (defendants) were highly intoxicated. He tells me it was messing about, high jinks which unfortunately went over and above what was intended at the time."

Judge Nicolas Cartwright said: "Mr Evans was the more aggressive. He is the person I dealt with by way of an immediate custodial sentence because he has previous convictions for offences of robbery and attempted robbery. You played a lesser role in this. In drink you did threaten to bottle your victim."

The judge said the defendant had 'turned something of a corner' and had been looking for work which was to his credit.

The judge jailed Evans for six months. He sentenced Heenan to a community order for 18 months with a requirement that he complete the accredited Resolve Programme on at least 27 occasions. He further ordered Heenan to pay a £200 contribution towards costs and £50 compensation to his victim.
